1. Introductory Provisions

1.1 Portal Operator

These Terms and Conditions ("T&Cs") govern the mutual rights and obligations between the operator of the Salutem Places portal ("operator") and users of the portal www.salutemplaces.cz ("portal").

1.2 Definitions

For the purposes of these Terms and Conditions:

•       Portal – the website www.salutemplaces.czused to facilitate short-term accommodation;

•       Guest – a natural or legal person who requests and books accommodation via the portal;

•       Host – a natural or legal person offering accommodation capacity via the portal;

•       User – collective term for both Guest and Host;

•       Booking – a binding reservation of accommodation made via the Previo booking system;

•       Booking System – the Previo software solution (www.previo.cz) integrated into the portal for managing reservations;

•       Payment Gateway – the Comgate payment service (www.comgate.cz) enabling online payment of bookings;

•       Accommodation Contract – a contract concluded between the Guest and the Host on the basis of a confirmed Booking.

1.3 Acceptance of Terms

By registering on the portal or making a Booking, the user confirms that they have read these T&Cs, understood them, and agree to comply with them. These T&Cs form an integral part of every concluded Accommodation Contract.

1.4 Role of the Operator

The portal operator acts as an intermediary for the conclusion of accommodation contracts between the Guest and the Host. The operator is not a party to the accommodation contract unless expressly stated otherwise.

The operator may provide payment services and booking administration without thereby becoming a provider of accommodation services.

2. Registration and User Account

2.1 Creating an Account

Accommodation can be booked without registration (as a guest) or via a registered user account. A registered account provides access to booking history, personal data management, and possible loyalty benefits.

2.2 Registration Requirements

Natural persons aged 18 or over and legal entities may register. The user is obliged to:

•       provide true, accurate, and complete registration details;

•       update registration details promptly upon any change;

•       protect access credentials (username and password) against misuse by third parties;

•       not share access credentials with other persons.

2.3 Liability for Access Credentials

The user is responsible for all activities carried out under their user account. In the event of suspected unauthorised access, the user is obliged to notify the operator without delay at info@salutemplaces.cz.

2.4 Account Cancellation

The operator is entitled to suspend or cancel a user account in the event of a breach of these T&Cs, provision of false information, or suspected fraudulent conduct. The user may cancel their account at any time by sending a request to info@salutemplaces.cz.

3. Previo Booking System

3.1 System Description

The portal uses the certified Previo booking system operated by Previo s.r.o. to process reservations. The booking system enables search of available accommodation, submission of enquiries, confirmation of bookings, and communication between the Guest and the Host.

3.2 Booking Process

The accommodation booking process proceeds as follows:

•       The Guest enters the required stay parameters (dates, number of persons, accommodation type);

•       The system displays available offers meeting the specified criteria;

•       The Guest selects specific accommodation and completes the booking form;

•       The Guest makes payment via the Comgate payment gateway or chooses another offered payment method;

•       After successful payment, the Guest receives a booking confirmation to the provided email address;

•       Confirmation of the booking constitutes conclusion of the Accommodation Contract.

3.3 Binding Nature of Booking

A booking is binding from the moment it is confirmed by the operator or Host and payment is made. Neither the operator nor the Host is obliged to confirm a booking, particularly in the event of unavailability of capacity or a technical error.

3.4 Technical Availability

The operator makes reasonable efforts to ensure continuous availability of the booking system but is not liable for outages caused by the Previo system operator, force majeure, or planned maintenance. Users will be informed of planned downtime with sufficient advance notice.

3.5 System Errors and Duplicate Bookings

In the event of a technical error leading to a duplicate or invalid booking, the operator reserves the right to cancel such booking. In that case, the Guest will be refunded the full amount paid.

4. Payment Terms and Comgate Payment Gateway

4.1 Payment Methods

Bookings can be paid via the Comgate payment gateway, which supports the following payment methods:

•       payment card (Visa, Mastercard, Maestro);

•       bank transfer (instant payment via internet banking);

•       digital wallets (as available from Comgate).

The operator reserves the right to change the range of payment methods offered.

4.2 Payment Processing

Payment transactions are processed by the secure Comgate payment gateway operated by Comgate a.s., registered address Gočárova třída 1754/48b, 500 02 Hradec Králové, Company ID: 279 24 505. The portal operator does not have access to users' payment card data. All payment transactions are conducted in a secure environment (SSL/TLS encryption) and comply with the PCI DSS standard.

4.3 Prices and Currency

All prices are quoted in Czech Crowns (CZK) including VAT unless expressly stated otherwise. The accommodation price includes services expressly listed in the description of the specific offer. Any local fees, tourist taxes, or other charges required by the municipality may be charged separately on site.

4.4 Payment Due Date

Payment for a booking is due immediately upon making the booking unless a different due date is expressly stated for the specific offer (e.g. payment on arrival). A booking without completed payment may be automatically cancelled after the specified deadline.

4.5 Payment Confirmation

After successful payment, the Guest automatically receives confirmation to the email address provided at booking. This confirmation serves as proof of payment. If you do not receive confirmation within 30 minutes, please contact the operator at info@salutemplaces.cz.

4.6 Invoicing

At the Guest's request, the operator or Host will issue a tax document. The request for a tax document must be made no later than 15 days after the payment date.

4.7 Payment Intermediation

The operator may accept payments on behalf of the Host and subsequently pass them on to the Host. From the moment the amount is credited to the operator's account, the Guest is deemed to have fulfilled their payment obligation to the Host.

5. Cancellation Policy

5.1 Cancellation by the Guest

Cancellation terms are listed with each specific accommodation offer. Unless the offer specifies otherwise, the following general cancellation policy applies:

•       Cancellation more than 30 days before arrival: 100% refund of the amount paid;

•       Cancellation 14–30 days before arrival: 50% refund of the amount paid;

•       Cancellation 7–13 days before arrival: 25% refund of the amount paid;

•       Cancellation less than 7 days before arrival: no refund.

5.2 Cancellation Procedure

Bookings are cancelled via the user account in the booking system or in writing to info@salutemplaces.cz. The decisive date and time is that of receipt of the cancellation request. Refunds are generally returned by the same payment method used for the original payment, within 14 business days of cancellation confirmation.

5.3 Cancellation by the Host

In the event of cancellation by the Host, the Guest is entitled to a full refund within 14 business days. The operator will make reasonable efforts to find alternative accommodation in a comparable category and at a comparable price, but this obligation cannot be guaranteed.

5.4 Force Majeure

In the event that accommodation cannot be used due to force majeure (natural disaster, armed conflict, government travel ban, etc.), the operator recommends handling cancellation terms individually. In such cases, the operator may waive cancellation fees at its discretion.

5.5 Withdrawal from Contract

The Guest – as a consumer – acknowledges that pursuant to Section 1837(j) of the Civil Code, they have no right to withdraw from an accommodation contract if performance is provided on a specified date.

5.6 No-Show

If the Guest fails to arrive for their accommodation without prior cancellation, they are not entitled to a refund of the price paid.

6. Rights and Obligations of Users

6.1 Guest's Rights

The Guest has the right to:

•       accommodation in accordance with the description and parameters of the confirmed booking;

•       a refund in the event of cancellation pursuant to these T&Cs;

•       submit a complaint or claim pursuant to Article 7 of these T&Cs;

•       information about accommodation conditions prior to making a booking.

6.2 Guest's Obligations

The Guest is obliged to:

•       provide accurate details when booking (first name, surname, contact email, phone);

•       comply with the house rules and regulations set by the Host;

•       respect quiet hours and the Host's instructions;

•       behave considerately towards other guests and the Host's property;

•       pay for any damage caused to the Host's property;

•       vacate the accommodation by the agreed check-out time;

•       inform the Host about all persons staying in the accommodation.

6.3 Host's Rights and Obligations

The Host is obliged to provide accommodation in accordance with the confirmed booking and offer description, and to inform the Guest of accommodation rules and any changes. The Host has the right to refuse accommodation to a Guest who violates the house rules or other regulations, or who has caused damage in the past. The Host is responsible for the accuracy, completeness, and currency of the information in the accommodation offer.

7. Complaints Procedure

7.1 Filing a Complaint

The Guest may file a complaint if the accommodation provided significantly does not match the confirmed booking or offer description. Complaints must be filed:

•       primarily without delay on site with the Host;

•       in writing to info@salutemplaces.cz no later than 30 days after the end of the stay.

7.2 Complaint Requirements

A complaint must include: the Guest's full name, booking number, description of the deficiency, photographic documentation (if relevant), and the requested resolution.

7.3 Complaint Resolution

The operator undertakes to resolve complaints within 30 days of filing. The Guest will be informed of the outcome by email. In justified cases this period may be extended, and the Guest will be notified accordingly.

7.4 Out-of-Court Dispute Resolution

In the event of a dispute between a consumer Guest and the operator that cannot be resolved by mutual agreement, the consumer has the right to contact the Czech Trade Inspection Authority (www.coi.cz) as the out-of-court consumer dispute resolution body. 8. Personal Data Protection

8.1 Data Controller

The data controller within the meaning of GDPR Regulation (EU) 2016/679 is the operator of the Salutem Places portal. Processing of personal data is governed by the Privacy Policy available at www.salutemplaces.cz/ochrana-osobnich-udaju.

8.2 Scope of Data Processed

The following categories of personal data are processed in the operation of the portal:

•       identification data (first name, surname, date of birth);

•       contact data (email, phone number, address);

•       payment data (account number for refunds – card payment data is not stored by the operator);

•       booking data (stay dates, accommodation type, number of persons);

•       technical data (IP address, cookies, website behaviour via Google Analytics).

8.3 Google Analytics

The portal uses the Google Analytics 4 (GA4) service operated by Google LLC for traffic analysis and user behaviour. Google Analytics uses cookies to collect anonymised statistical data. User IP addresses are anonymised. Users may opt out of Google Analytics tracking:

•       via the cookie consent bar on the portal;

•       by installing the Google Analytics opt-out add-on (https://tools.google.com/dlpage/gaoptout);

•       through browser settings.

Data collected via Google Analytics is processed in accordance with Google's data processing terms; data may be transferred to the USA on the basis of EU standard contractual clauses.

8.4 Cookies

The portal uses cookies. On first visiting the portal, users are shown a cookie consent bar through which they can manage their settings. Further information is available in the Cookie Policy at www.salutemplaces.cz/cookies.

8.5 Data Subject Rights

Users have the following rights regarding their personal data: access, rectification, erasure (right to be forgotten), restriction of processing, portability, objection, and withdrawal of consent. Rights may be exercised at gdpr@salutemplaces.cz. If there are doubts about the lawfulness of processing, a complaint may be lodged with the Office for Personal Data Protection (www.uoou.cz).

8.6 Transfer of Personal Data to the Host

The Guest's personal data is transferred to the relevant Host to the extent necessary for processing the booking and fulfilling the accommodation contract.

The data transferred includes in particular the Guest's identification and contact data, booking data, and other information necessary to provide the accommodation.

The Host acts as an independent data controller in relation to these data and is responsible for processing them in accordance with applicable data protection law.

The operator is not liable for further processing of personal data carried out by the Host.

9. Payment Security (Comgate)

The Comgate payment gateway facilitates payment transactions in accordance with PCI DSS Level 1 requirements. The portal operator does not participate in the payment process and does not have access to sensitive payment data. All communication with the payment gateway is encrypted via TLS 1.2/1.3. 10. Liability and Limitations

10.1 Operator Liability

The portal operator acts as a booking intermediary and is not liable for:

•       the quality, standard, or availability of accommodation provided by third parties (Hosts);

•       damage caused to the Guest by the Host;

•       outages of the Previo booking system or the Comgate payment gateway;

•       inaccuracies in accommodation descriptions provided by Hosts;

•       damage arising from force majeure.

The operator is liable for its own activities to the extent laid down by law. Liability for performance of the accommodation contract rests with the Host.

10.2 Limitation of Liability

The operator's liability for damages is in all cases limited to the amount of the price paid for the specific booking, except in cases of intentional misconduct or gross negligence.

11. Intellectual Property

All portal content (texts, photographs, graphics, logos, software) is protected by copyright and other intellectual property laws. Without the prior written consent of the operator, any copying, distribution, or other use of this content is prohibited. Photographs and descriptions of accommodation facilities are the property of the respective Hosts and are published with their consent.

12. Final Provisions

12.1 Governing Law and Dispute Resolution

These T&Cs and all legal relationships governed by them are subject to the laws of the Czech Republic, in particular Act No. 89/2012 Coll. (Civil Code), Act No. 634/1992 Coll. (Consumer Protection Act), and Act No. 110/2019 Coll. (Personal Data Processing Act). Disputes arising from the contractual relationship between the Operator and the User fall within the jurisdiction of the general courts of the Czech Republic.

12.2 Amendments to T&Cs

The operator reserves the right to amend these T&Cs at any time. Users will be notified of changes by email or announcement on the portal at least 14 days before the changes take effect. If the user continues to use the portal after the amended T&Cs take effect, they thereby express their agreement to the changes.

12.3 Severability

If a court or other competent authority finds any provision of these T&Cs to be invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid or unenforceable provision will be replaced by a provision that best reflects the original intent.

12.4 Effective Date

These T&Cs enter into force and effect on 1 January 2026. Previous versions of the Terms and Conditions are available on request.
